General Terms and Conditions of the company "Mano Wear UG (haftungsbeschränkt)"

1 - Scope and Overview

The following General Terms and Conditions (T&C) apply to all business transactions in the Mano Wear online store between Mano Wear UG (haftungsbeschränkt) and a customer in the version that is current at the time of the purchase. This website is operated by Mano Wear UG (haftungsbeschränkt). Throughout the site, the terms “we”, “us” and “our” refer to Mano Wear UG (haftungsbeschränkt).

Mano Wear offers this website, including all information, tools and services available from this site to you, the user, conditioned upon your acceptance of all terms, conditions, policies and notices stated here.

By visiting our site and/ or purchasing something from us, you engage in our “Service” and agree to be bound by the following terms and conditions (“Terms of Service”, “Terms”), including those additional terms and conditions and policies referenced herein and/or available by hyperlink. These Terms of Service apply to all users of the site, including without limitation users who are browsers, vendors, customers, merchants, and/ or contributors of content.

Please read these Terms of Service carefully before accessing or using our website. By accessing or using any part of the site, you agree to be bound by these Terms of Service. If you do not agree to all the terms and conditions of this agreement, then you may not access the website or use any services. If these Terms of Service are considered an offer, acceptance is expressly limited to these Terms of Service.

Any new features or tools which are added to the current store shall also be subject to the Terms of Service. You can review the most current version of the Terms of Service at any time on this page. We reserve the right to update, change or replace any part of these Terms of Service by posting updates and/or changes to our website. It is your responsibility to check this page periodically for changes. Your continued use of or access to the website following the posting of any changes constitutes acceptance of those changes.
Our store is hosted on Shopify Inc. They provide us with the online e-commerce platform that allows us to sell our products and services to you.

 

2 - Contract Partner and Closure

The following conditions regarding contract closure apply to orders via our internet shop at the domain http://www.mano-wear.com. Should a contract be closed, the contract partner is

The presentation of our goods in the Mano Wear online store does not represent a legally binding contract offer on our part, but is a strictly non-binding request that the buyer purchases goods. By ordering the selected goods, the customer makes a binding offer to close a contract.

We immediately confirm the receipt of the order using an automatically generated email to the customer (order confirmation). In doing so, we accept the contract offer and a contract is closed.
We save the contract text from orders in our online store and send the customer the order information as well as our T&C by email. The T&C can be also be accessed at any time under https://mano-wear.com/pages/terms-and-conditions.

3 - Shipment Terms

Delivery within the EU and to Switzerland is free of charge.

We reserve the right to charge a fee of €12.90 or €28.90 for international shipping outside of the EU respectively, depending on the distance. You will be separately notified of the shipping costs before completing your purchase in the Mano Wear online store.

4 - Right of Revocation & Return Policy

As a consumer, you are intitled to the unrestricted statuory right of revocation. During the 14-day statuory revocation period, the statuory conditions apply. Mano Wear extends this statuory right of revocation to 30 days.

This means that you can withdraw from the contract without the statement of any specific reasons. The 30-days cancellation period starts with the day on which you, or a third party named by you, which is not the delivery party, have/has phyiscally received the delivery.

For keeping the cancellation period it is sufficient to send off the notification message by email/mail within the cancellation period.

For your retour please print out your ordering overview or your invoice and enclose it with your retour.

On this printout please annotate the retour reason next to the retourned article(s):

3. - don not like colour(s)
4. - do not like design
5. - do not like fit

7. - defect article
8. - wrong article

Upon receival of your retour, we will verify the retour to be of immeculate and flawless quality. If this is the case, we will refund you by the same payment method you have been invoiced by. This can take up to 30 days, please remain patient. Please pay attention to clean and flawless goods.

Please note that Mano Wear will be bearing the costs for retour sendings from within the EU. Customers from non-EU countries bear the direct costs of returning the goods. If Mano Wear is nevertheless charged with the return shipping costs, these will be offset against the refund of the returned items and the amount of the return shipping costs will be retained. Please pay attention to the return period of max. 30 days.

5 - Retention of Title

We reserve our property rights over the goods until purchase price has been paid in full. 

6 - Accuracy of Billing and Account Information

We reserve the right to refuse any order you place with us. We may, in our sole discretion, limit or cancel quantities purchased per person, per household, per firm or per order. These restrictions may include order placed or under the same customer account, the same credit card, and/or order that use the same billing and/or shipping address. In the event that we make a change to or cancel an order, we may attempt to notify you by contacting the e-mail and /or billing address/phone number provided at the time the order way made. We reserve the right to limit or prohibit orders that, in our sole judgement, appear to be placed by dealers, resellers or distributors.

You agree to provide current, complete and accurate purchase and account information for all purchases made at our store.

7 - Shipping Damage

If you receive goods with apparent shipping damages, please immediately register such damages with the shipper and contact us immediately. The failure to issue such a complaint or to contact us does not affect your statuory claims or their reinforcements.

 

 8 - Pre-Ordering

PRE-ORDER: These are items that are not yet available and/or are currently sold-out from our online shop.

8.1 Payments

You will be charged a down-payment at the time of placing the pre-order. If Mano Wear is unable to commence shipping the products on or before the 8-months anniversary of your placing the pre-order, Mano Wear shall process a full refund to you.

8.2 Delivery Schedule

Although we will make efforts to begin delivering products as soon as reasonably practicable, you understand and agree that there may be delays. An estimated time of delivery (ETD) is only an estimate, is subject to change, and Mano Wear does not represent or warrant that it will be able to ship the product by the estimated date.

 

8.3 Price

The purchase price does include taxes for customers that are domiciled within the EU. For customers outside of the EU, taxes and other government charges are your responsibility. If the price drops after you have pre-ordered, we will refund you the difference. If the price goes up, your order is secure at the the low price. The pre-order price is valid from the moment you place the pre-order right up to 10 days after you receive the item.

8.4 Cancellation

You or Mano Wear may cancel this reservation by terminating the Pre-Order at any time for any or no reason prior to our notice to you that our product is ready for delivery. If you do so prior to our notice of delivery, you will obtain a refund of the purchase price without interest. If Mano Wear cancels your reservation you will receive a full refund of the purchase price without interest (and you will not pay any processing fee).
